This Privacy Policy applies to the data collected by Lorigami SASU, the company editing Toolten (hereinafter, “us”, “we”, “Company”), seated at 16 av. du General de Gaulle, 94500 Champigny-sur-Marne, France. This Privacy Policy document contains the types of information that is collected and stored by us and how we use it.

It is our policy to respect Your privacy regarding any information we may collect while operating our website and application. We only ask for personal information when we truly need it to provide a service to You. We collect it by fair and lawful means, with Your knowledge and consent.

This Privacy Policy, supplemented by the following terms, set forth the general rules and policies governing Your use of the Application:

1. Definitions

For the purposes of this Privacy Policy, words with a capital first letter are defined at the begining of our Terms of Use, please refer to it as needed.

2. Cookies

A cookie is a string of information that a website or application stores on a visitor’s device, and that the visitor’s device provides back each time the visitor returns. By agreeing to this Policy, You acknowledge that You are entitled to and allow us to create cookies on the Device You use to access the Application.

2.1. User registration and logging in

An identifying cookie is technically mandatory for anyone wishing to use an account in the Application. This cookie is used for the sole purpose of providing the service.

The creation of the cookie and the identification of registered users in general, along with the storage of Your data, is made possible by the use of Google Firebase’s services. By creating an account, You agree that Google will host Your data, and You agree to Google Firebase’s own Privacy Policy which describes how they will handle this data.

2.2 Anonymous usage reports for the website and application

Our purpose in collecting non-personally identifying information is to better understand how the visitors of the Application use its website and application. From time to time, we may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website or application.

The generation of anonymous usage reports is achieved with the help of Google Analytics. In the process, Google will collect non-personally-identifying information of the sort that user devices typically make available, such as the device operating system, browser type, language preference, referring site, and the date and time of each visitor request. To make this analysis possible, Google will also temporarily store Your IP address, which is a potentially identifying piece of information, for a maximum duration of 14 months.

By agreeing to our Privacy Policy, You acknowledge that You agree that the described information may be shared with Google, and You agree to Google Analytics’s own Privacy Policy which describes how they will handle this data.

2.3. Protection against spam

Contact forms are protected by reCAPTCHA and the Google Privacy Policy and Terms of Service apply. These cookies are mandatory.

3. Access logs

The Site collects potentially personally-identifying information like IP addresses and access times, for a minimum duration of a year, as required by the law. We only discloses user IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below.

4. Storage of personal data

None of Your personal data is stored on our servers until You create an account. While using our application without account, Your data is stored locally on Your device only. The creation of an account will potentially have us store information such as an email address, a name, a password, a picture, a token to an associated Google or Facebook account, all of which can be managed from within the application. A paid subscription to our services will get You access to advanced features and transfer a backup of Your data on our servers (e.g. tasks, projects, sessions). Deleting the information in the application will also delete it from the backup on our servers.

We only retain collected information for as long as necessary to provide You with the requested services.

What data we store, we’ll protect within commercially acceptable means to prevent loss and theft, as well as unauthorized access, disclosure, copying, use or modification.

As stated sooner, the storage of Your data relies on Google Firebase’s services. By creating an account, You agree that Google will host Your data, and You agree to Google Firebase’s own Privacy Policy which describes how they will handle this data.

5. Access, rectification, withdrawal of consent, erasure

Most of Your data is accessible and editable by Yourself from within the website/application.

Should You wish to withdraw Your consent and stop using the Application, You are free to delete Your account along its associated data from within the application at any time. In such case and if You are a paid subscriber, please refer to our Legal Terms concerning subscription fees for billing details.

The deletion of Your account does not automatically remove Your email address from our marketing emailing system. However, You can opt out of our mailing list using the unsubscribe link at the bottom of our emails, or send us a request for removal at hello@toolten.io.

Other pieces of information acquired by communicating with our staff (emails, Twitter, questionnaires, surveys, etc.) may be retained by the Company.

Some of Your data may not be deleted even if requested, to satisfy to legal obligations or to preserve materials potentially involved in legal claims, such as traces of financial transactions.

6. Links to external sites

Our Service may contain links to external sites that are not operated by us. If You click on a third party link, You will be directed to that third party’s site. We advise You to review the privacy policy and terms and conditions of every site You visit.

We have no control over, and assume no responsibility for the content, privacy policies or practices of any third party sites, products or services.

7. Protection of certain personally-identifying information

We discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and present or future affiliated organizations that (i) need to know that information in order to process it on the Company’s behalf or to provide services available in the Application, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organizations may be located outside of Your home country; by using the Application, You consent to the transfer of such information to them. We will not rent or sell potentially personally-identifying and personally-identifying information to anyone. Other than to its employees, contractors and affiliated organizations, as described above, we disclose potentially personally-identifying and personally-identifying information only in response to a subpoena, court order or other governmental request, or when we believe in good faith that disclosure is reasonably necessary to protect the property or rights of the Company, third parties or the public at large.

If You are a registered user of the Application and have supplied Your email address, we may occasionally send You an email to tell You about new features, solicit Your feedback, or just keep You up to date with what’s going on with the Application and our products. We primarily use our blog to communicate this type of information, so we expect to keep this type of email to a minimum. If You send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to Your request or to help us support other users. We take all measures reasonably necessary to protect against the unauthorized access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Although most changes are likely to be minor, we may change its Privacy Policy from time to time, and in our sole discretion. We encourages visitors to frequently check this page for any changes to its Privacy Policy. Your continued use of this site after any change in this Privacy Policy will constitute Your acceptance of such change.
